ORIGINAL POST

can anyone confirm the law on this. there is a total of 4 public holidays during the 10 weeks of my maternity leave and my employer is telling me that they do not compensate for those public holidays. ie i expected to add on 4 extra days of leave to make up for those PHs. please advise if anyone has any info on this.

thanks

It depends on what the contract says, if it states "calendar days" then it's according to the calendar so weekends and public holidays are counted. Unless your contact states 10 weeks of "working days".

make sure you are aware (contractually) of the start date of your mat leave...my wife's was two weeks prior to delivery, so essentially only 8 weeks fo recovery time...this can vary (luckily?!? our daughter was 5 weeks preemie, so a moot point!lol)

Agree it depends on your contract. Mine said 12 weeks so doesn't only 12 weeks regardless of public holidays - ie: can't add public holidays on top of the 12 weeks. Shame!
