Break lease - what happens with the deposit?

I have a one plus one year contract with a break lease clause. I'm currently in the second year of the lease (14+ months) and i need to leave Hong Kong. I paid two months deposit upon moving in.


My question is as follows: am i entitled to get the deposit back after the 60days notice period? I understand that the land lord might make deductions for wear and tear and stamp duty etc. But i should be able to get most of the deposit back right?!

it may be advisable to just withold rent payment of your final 2 months' stay, and tell the landlord to deduct it from the deposit you have with him.


i heard many horror stories of landlords refusing to pay back the 2 months deposit citing all sorts of required "repair" work. if you are in a rush to leave HK, it will be a big hassle getting your money back from an unreasonable landlord.

I always suggest to ask your landlord to take your last month's rent out of your two-month deposit; almost without exception they will agree. It is my believe that any landlord that is willing to agree on such arrangement is very likely to return the remainder of the deposit as well. It also avoids confrontation, because I am also familiar with one case where the tenant withheld rent without informing the landlord and the tenant was served with an eviction notice, got sued and had to pay the court costs.
