when I signed my lease, I deposited the normal 2 months rental as deposit. I have been in contact with a few landlords here in HK and they tell me that it is common practice to not pay the final 2 months rent and instead have the landlord take the rent from the deposit instead.
Apparently, the tenant has more power in the eyes of the law then the landlord.
Is this also other peoples' experience.

It's common practice but it has little to do with tenants' power - more to do with trouble getting back the deposit, particularly if leaving HK. The landlord should be advised if you take this action, otherwise they could sue for non-payment of rent.

thanks Claire, very good advice. Just a formal letter stating how we will run out the tenancy i guess will suffice so they do have written knowledge of our approach and not to intentionally default on payment.
