Stamp Duty

We are about to sign a lease on a cheap little weekend getaway place in the country side and the recently widowed landlord (house has yet to be completely transfered into her name) says she cannot be bothered going ahead with the Stamp Duty. It may be a can of worms for us, the agency and the landlord. Does anyone have advise on matters like this?

Ýes, Stamp Duty should be paid. The agent should organise this, but the landlady has to pay her share. If she absolutely refuses then I suppose you could pay her half, but either way make sure it's paid.

If Stamp Duty isn't paid, then you won't be able to take any legal proceedings against the landlady, should this ever be necessary in the future. Also make sure it's paid within the time limit otherwise it will be a lot more:

not exceeding 1 month late, double the amount of stamp duty

exceeding 1 month but not exceeding 2 months late, four times the amount of stamp duty

in any other case ten times the amount of stamp duty
