Late in paying .....

Can anyone advice me what to do as my tenant is late paying rental and as he is in the last 2 months of lease i think maybe using deposit up instead of paying rental. if he doing this what will i use to pay for any damage done? i am fair and will return deposit if all ok. Should i contact small claims pls let me knw

Your tenant is in breach of contract so post this on the legal forum to see if you can get some sound advice there as F348 has not given you sound advice.

F348, I haven't gone through all of Katie's posts, but maybe you could enlighten all of us as to when katie suggested a tenant to use up a deposit and then not compensate the landlord/lady for any damages incurred? I guess that it must've been within the last week or so (since you've only been a member for 9 days)


I recently completed my rental - I did not pay rent for the final month and left one month deposit to cover any damages. In the end, since I had overpaid my gas bill, I had left more than one month rent with my landlady. There were a few things which needed to be settled (I lost the keys for bedrooms and had to remove a wardrobe)... but unless the damages are egregious... one month + of rent shouldn't be a problem. Since Katie has zero months rent, then I would suggest that she do a quick walk through of the apartment to identify any egregious problems.


If she finds any then maybe you could recommend a few good money collectors to make sure that she can recover at least enough money to cover the damages. I think that you can suggest a few?

All tenant before this one ask me if ok to use up deposit and tell me to view house. I look and if all ok it is ok with me. this guy never ask and just go ahead i hve not view place in 2 yr so hve no idea what condition is. Thank you for advices tseyong i will try to view flat but tenant not answer phone fax or email so hard to contact. Just would like to now of any legal action i can take.
