we have friends leaving hk and we are taking over ther remaining 18 months of their lease. They are asking if we can keep certain things like water and electricity in their name in case they return to HK. They have also asked that we pay them 2 months the deposit that they originally paid for the flat, the probalem lies in teh fact that we have no way of contactin the landlord - aside form through our friend, and therefore cannot even get rent receipts to claim against tax, in our name............is this right??

ok thanks...........should i really be paying them the deposit through - cant quite figure that our as ultimately at the end of the lease they will be getting the money back from the landlord surely

There is something like a "lease surrender agreement" that should be signed btw your friend and their landlord, for you to take over the lease without any problem. Ask them.

I think walkup2 is right; they're not transferring their lease but subletting their apartment to you, which unless they have it specified in their lease (which I doubt) is a breach of the tenancy agreement. As for keeping water and electricity in their name in case they come back to HKG, that doesn't make sense. Maybe they eventually want to apply for PR and they think that by keeping the lease and utilities in their name it will prove that they're still here. I don't know, but I know this doesn't sound like a good proposition. I would not be paying them 2-months' deposit because you may not get it back from them. Be careful about doing business with friends.
