flat sold, new landlord

I am a tenant and my landlord is about to sell the flat to a family that will want to move into the flat. Will the new owner have to honour the 12+1 no-break clause (due Q2 2010, with tenancy agreement signed til Q2 2011), or can they terminate the tenancy agreement early, since they want to move in themselves?


I believe this definitely was the case under the old style (pre-2004) tenancy agreements.


Any advice would be much appreciated!

Hi onemorething, my landlords want to sell the flat too but my agent has confirmed that my TA protects me from being kicked out by a new landlord who has to honour all the terms of the TA. Check yr TA carefully and/or with your agent as yr landlord may have inserted a provision addressing that. If not, u should hv no problem. Future earnings from the flat i.e. yr rent, is factored into the negotiated price as well.


If u don't mind moving, let them buy u out til Q2 2010 when yr fixed term ends ... again, my agent's 2 cents when I discussed my parallel issue with her tho my landlords haven't found a buyer yet.
