Water leakage liability

I bought my house (villa style, not a village house) in the New Territories direct from the developer that included a "no water leakage" guarantee for 3 years.


The 3 years expired on 31 December 2010. In August 2010 I reported a water leak problem and the management arranged to have a repair carried out. It's now a year later and that same leak is back but much larger. We had very little rain after the initial repair so it was almost impossible to see if the repair had worked or not.


It is now clear that that the repair clearly did not work but the warranty period has expired. I am of the belief that the developer should honour this repair as the original problem was reported before the warranty expired. He of course disagrees and doesn't want to pay for or carry out any reapair.


Does anyone have any advise about who I can talk to to find out if I have any rights to fight this legally? Is there a small claims court system in HKG?


I am going to have to pay to get this fixed and then try and fight to get the money back later.


Any help or advise will be greatly appreciated.
