Breaking Provisional Tenancy agreement

Hi,

I need some advice on what is the best way to break a provisional tenancy agreement.


I have paid a deposit of HK$10,000 to the landlord via the property agency. Do I have a right to get back the money, at least partial amount.


Do I need to pay the agency the full amount of agency fees since I have not signed the tenancy agreement.

Ken is correct and unfortunately there is no other legal approach other than to take on the lease which I'm guessing you no longer want to do.

I have a friend in a similar position however, they have payed the two months deposit and first months rent. They now find themselves in a situation where they are not able to rent the property.

Will they loose the two months deposit and the landlords agents fees?
