Extension on the terrace -Problem!

Hi, I am building an extension right on the terrace and Building dept and stop the construction. I understand from friends and contractors that it is common that Buidling Dept stop the construction since I do not have any permit to build. However, people still build anyway and what the Building Dept can do is they put an record on your property so that when you finally sell the property, you have to tear it down before you can make the sale. The Building Dept can not come into your property to tear down the extension as they have no right to do so.


Can someone kindly advise if that is true? I am more than happy to tear it down when I sell.

If you are guilty of contravening the Buildings Ordinance, you can be fined (up to $400,000, depending on the offence), fined for continuing the offence (up to $20000 for each day during which it is proved to the satisfaction of the court that the offence has continued), and imprisoned (up to 2 years, depending on the offence).


Cap 123, Sec. 24:


(1) Where any building has been erected, or where any building works or street works have been or are being carried out in contravention of any of the provisions of this Ordinance the Building Authority may by order in writing require-

(a) the demolition of the building, building works, or street works; or

(b) (Repealed 43 of 1993 s. 6)

(c) such alteration of the building, building works or street works as may be necessary to cause the same to comply with the provisions of this Ordinance, or otherwise to put an end to the contraventions thereof,


(3) If an order made under subsection (1) is not complied with, the Building Authority may demolish or alter or cause to be demolished or altered such building, building works or street works. (Amended L.N. 283 of 1986; 43 of 1993 s. 6)


And you get the bill.
