Terminate Lease, 1 mth notice?

Hi there!,

I have been renting my studio for 2.5 yrs now. Lease renewed for one year 6 months ago.

Now I need to leave HK, could I terminate the lease by giving the landlord one month notice? If not, do i have to pay the rest of the rent?


Appricate if someone can help me.

need to check your lease - you may have to give 2 months notice - which means two months rent (one month you are here and one month after you leave) unless you find someone who can take over the lease for you - so the Landlord doesn't miss any rent.


if they are reasonable they may see it as an opportunity to up the rent, and be happy you will be leaving early - but then why not take your rent for the month and let it someone else during the same month. You should also have your two months of deposit that you can use to pay the rent in lieu of taking it out of your pocket and then having to get refunded - most people would recommend you do this so you get your money before you leave without a court case.

I would suggest then that you do not pay rent for the last month you are there.. and just allow your deposit to be used up- rather than having to pay out more money and have a reduced chance of seeing your deposit when you leave.

That's a good idea!

My lease ends Sept 06. I am leaving mid-June. If I notify the landlord mid April, is it possible the one month penalty count from mid-May to Mid June? or have to pay July rent as well? (rent pay 1st every month)

Pls forgive me if u find my question silly. i am new to this & have no idea about the rules and practice.

If you are leaving Mid June then give notice mid April in writing and you should be all clear with no loss. I am not sure if you should tell them you will use the deposit money to pay. I have never done that - but i know of others who have.

That is correct - unless I can't count but Mid April to Mid June is 2 months notice.
