Tenancy Agreement help as change of new landlord

Wondering if anyone can give me some advice that be useful. Recently, a new landlord had bought the flat, I am fast approaching one year that is a 2 years agreement but with break clauses.


The agreement stated :


It is agreed that at anytime after 12 months from effective date, the landlord may exercise the break clause to terminate the tenancy by serving 1 month written notice to that effect on the tenant or paying one month's rent in lieu of notice. The length of the tenancy shall NOT BE LESS than 13 months inclusive of one month written notice.


I moved in 1st March2010. I would like to move out at 31st of March2011 making that 13 months.


The new landlord want to move in to live 1st March2011 and will pay amount of one month rent to replace the one month written notice.


My question is that do I still have the right to stay until end of March as it stated No less than 13 months.


Or the landlord can kick me out after 12 months and pay the me one month to replace the written notice.


I think it is very tight, I want to stay until end of March.... am I miss reading the contract... much appreciate all advices.

You don’t have to accept the landlords offer if the lease wording is as you state above…...if you can move out early it is obviously economically more attractive to you….

Will the I be able to negoiatate the terms of more than one month?

Seems like you don't have a right to stay on past 12 months if it's written that way. Yes, says the lenght must be 13 months but that in inclusive of 1 month's notice which the landlord can get around by paying you 1 month's rent in lieu.


Have you tried persuading the landlord to move in a month later?
