Hi, we are experiencing water damage in our apartment from the apartment upstairs (their balcony).
Unfortunately, the owner of the upstairs apartment is not cooperating to fix the balcony. This has been going on for a couple of years and we're fed up with it..
Can anyone recommend a govt dept to go thru for complaints to maybe enforce action? or a good lawyer? Any experience to share? Suggestions?

I think you can also ring up the Building Dept and Food & Environment Dept, they can carry out some tests for you

I have had similar, call the food & environmental heath dept (FEHD) they will inspect upstairs and your area of damage and if necessary carry out a water test with dye. They pour dye in the drains of upstairs, if it leaks through then upstaiars have to fix it. If no dye is detected and the area is still wet then they call in the BD who flood the floor area with dye and if this leaks through the upstairs owner has to fix it. Once the owner is contacted by FEHD you will find that he suddenly becomes more co-operative...it should not require legal action unless he refuses entry to the gov depts. GOOD LUCK!

Thank you all! Arranged for an independent expert to come in and conduct a water test of upstairs balcony and owner would not allow proper test (only a portion of his balcony)..hopefully we won't need to go thru formal channels, we'll see..

The flat above have modified the back utility are and helper's toilet. Our ceiling to the same area is moist. Our contractor is of the opinion that water from above is causing water damage.
Over time, the overhead cabinet in the helper's toilet has been damaged.
The building management is trying to have the owner of the flat above to rectify their problem but we are left to pursue damage.
At a minimum, they would need to replaster and paint the damaged walls in our flat. The overhead cabinet might be beyong repair due to age and damage. Can we ask for a replacement considering there is depreciation. However, if it were not for the damage, we wouldn't need to replace it. Where do we stand?
Does anyone has experience how long will it take for the BD to arrange the water test?

The independent expert I used seemed pretty good. They start by taking photographs of damaged areas, and also detecting problem spots with infrared technology. They then flood the area in question and come back the next day and compare the infrared readings for a decrease in temp (eg. water cools the concrete) to test potential source of the damage..If you need a contact detail, pls email.
