Advice needed plz on Apt issue

I took over my apt from a friend who negotiated with the agt, and as I am the " tenant '', the agt refuses my request to discuss a proper lease, give receipts for rent paid upto date, set the electric charges @ $ 540 per month which is for a small fridge/ tube light which is I do beleive not correct. And no bill too. He has been badgering me for the rent in the past when it is not even due yet and tonite he did the same, insisting I settle the elec bill and rent ( due on 18th May ). He turned off power 10 days ago for 2 days as I refuse to pay elec unless he gives me a bill and the opportunity to discuss the lease or other apts as I told him I was not happy. 2 months ago he said he would move me to another apt but he obviously lied. On friday he let it slip that the apt was a short term type and so from the very beginning, he has been harassing me, throwing diff amounts 14k - 10 k, that is supposedly owed, and not true. Tonite I told him to 1st spek to me with courtesy as I do him, to acnowledge that I am the tenant not my long gone friend and Iam going to register a complain against his unprofessionalism / lies and unless we re able to discuss the matter and all transactions with receipts and bills, Iam not in the mood to be spoken to with such discrimnination for thats how he treats me ( Iam originally from India, in Hk 21 years ). Of course he did not like that suggestion and threathened to and called the cops, I just walked off for Iam really very tired of being discriminated upon, a sure thing i am subjected to every single interaction from 7-11 to a bank tellar and having just moved to the city after 18 yrs in outlying Is where I worked from home, so visits to the city was very infrequent. But living in the city nearly a year has made " Discrimination" the most " change " when Iam asked by my family whats it like to live in the city now???

and so YES my daily dose of racism is affecting me alot to the point where i am not keen to step out even for daily groceries for my patience is running out and its getting harder to not react with anger...

( gone off my point a bit but its also how the agt has been to me )

So - if the elec has been turned off when I get home, or agt refuses to discuss a formal lease, can I be kicked out as he keeps saying that. I realise that he does all this drama to get me all pissed off and to move out for its a game he plays to then get in new tenant and continue the same and thus make the $$$ ... Thank you

sorry this is not discrimination, this is stupidity: why do you still live there??? you have apparently no tenancy contract whatsoever (else why would you raise such issues), so move out already and find a decent place

Thanks for responding. I do appreciateit . I would also like to take this opportunity to thank the wonderful Asiaxpat team for providing us such an effective, informative and wonderful service. I pleadge my continuance endevours to promote Asia xpat to anyone I know and meet, in Hk and friends living across Asia. I did a fair bit of research on my issues with the agt, lands tribunal and so far i am sorry to say that there seem to be no definate legal answers for my case ! I have and continue to make my apt into a home for me and my son, and as its been our home, to uproot ourselves and also the time, financial expenses incurred to do it all over again is not very easy for me, and all that inconviniece simply due to the unprofessional ( to put in a word ) attitude of the agent. and Its a problem faced by a few friends i soon found out. So how are we to tackle such unfair tactics.

Also can anyone please confirm if its a fact that to disconnect the electricity is an illegal act and against human rights ??? Thank you

Darilang. I would suggest you see a lawyer however this all sounds a bit strange. Firstly, if you do not have a proper rental contract (best with stamp duty paid) then you have no right to be in the building. Doesn't appear to have anything to do with discrimination or human rights. To be honest, it sounds like you are squatting. It also sounds as if the landlord will not give you a proper rental contract because the building he is letting out may be illegally sub-divided or he may not be paying tax. Do you know the landlord's name? If so, you can go to the Inland Revenue Office and say this landlord is not giving me receipts for the money you pay him. If you don't know the landlord's name then you can still go and tell them the address. It is best if you write to the Indland Revenue as they then have to act.
