I need to move out 3 months early...

I am renting a small single bed flat in Central - lower mid levels- and will need to move out 3 months early as my wife is due to give birth meaning the flat willno longer be suitable for us.

Can I sublet it for 1-3 months?

It seems the rental rules/laws here would mean I have to serve the full 12 months of my lease and pay for two places if we move early?

Most Hong Kong leases cannot be assigned and no subletting is permitted without the written permission of the Landlord.


Whether you can terminate the lease before the term of the lease expires depends on whether there is a break clause in the tenancy agreement. Given that the term of your lease is relatively short, it is unlikely that there is a clause which allows you to serve notice to the landlord and move early.

Rentals rates are higher now than when you entered into the deal. Thus the landlord may be more flexible You can always ask to break early and pay for the brokers commission to find a new tenant. Everything is negotiable in HK. But most loandlords will not allow subletting.
