What can I expect a divorce to cost if there are no children? There may be disputes about money so that is the sticking point. What is a good law firm to approach, that is reasonable on costs?

i divorced in true grown up way, with 1 kid, it costed us HK$ 800 or something like that. was all very simple and straight forward, only problem i had is you have to swear on the bible. me not being religious i said no, then i was told i have to or........so i just said a lie grins.
i think cost mainly depends on your relation, you wanna kill each other or just the best for each other?

Is it possible to get divorced in HK without a lawyer if it's uncontested and both parties agree on it?

i wish the proceed with divorce. v simple, no kids, not asking for anything. after reading up http://www.judiciary.gov.hk/en/crt_services/pphlt/html/divorce.htm, there seems a lot of paper work and court appearances. can anyone refer me a cheap lawyer that could take care of the administration / paperwork away. It's hard enough as it is .... thanks

My wife and I are in the process of getting divorced. We have agreed on a settlement and there are no kids involved. When she went to the family court, they told her that if my savings are greater than $200k, the court costs could be more then $60k. I am confused by this - if the divorce is amicable and uncontested. how can they justify such high fees? I have already divorced once before 10 years ago in Hong Kong and I remember the court fees were minimal. Have they given the wrong advice or did my wife misunderstand?

Well, if you and your wife are just going in for an "amicable" and "uncontested" divorce, there is absolutely NO reason for you to be going to court. You can sort this out through lawyers who will apply for your decree nisi and then you will be granted your decree absolut (final divorce papers) a few months later. The whole process from start to finish should take you about 6 months (4 months for the nisi and then another 2-3 months for the absolut) and shouldn't cost you much. If you do the applications yourself, it should be dirt cheap, if you go through lawyers and you truly are going for an amicable and uncontested divorce, then that too shouldn't cost you more than the time it takes to draw up and sign papers to that tune.
So in short, the 60K your wife has mentioned is how much a day or two in court would cost you. This will not be an issue as you will not need to go to court in the first place.
When I went through hell with my ex there was talk of going to court and it was not something I was looking forward to as the court charges could cost upwards of 30K a day or something, you do not want to go there.
Good luck and hey, should be able to get an amicable/uncontested divorce for under 15K without having to step foot in court.

OK I know that the posts here are a bit old but I didn't want to start a new one.
My question is: Is there a law enforced in Hong Kong about the minimum pay for your spouse?
In my case we both agree on a lump sum payment which would get her started again in her home country.
Do we still have to get in front of the court? We both agree on the settlement.

Nope, you can either sort out the paperwork yourself (which will require your time and a minimum amount of money) and IF you want the lumpsum payment to be all "legit" and co CYA (cover yer ass) about ensuring there will be no further financial claims made to your estate, then I suggest you get a lawyer or a notary person to sign off on you guys agreeing to the lumpsum and agreed settlement.

So let me get this straight. If we want to settle on a lumps sum lament we have to go to a lawyer to sign papers that we both agree on the amount. But even then it goes in front of a judge who can still disapprove on the amount? Is that right?

I have three kids in my second marriage, I didn't get any protection from the 1st marriage as my ex petitioned the divorce in CA, finally I raised up my first boy by myself in a very difficult situation that I worked day by day and left him alone with a bad temper helper. He cried to called me when I was working and I have long face and arguing form my helper all the time.... My ex is driving Mercedes Benz and dating and different girls in US ( from my ex-sister-in-law information).
Now with the improper behaviour and irresponsible father of my hubby (evidence from hospital and clinic and person), I have to do something to protect the three kids, swear to God!
