I need legal advice on getting divorced

Hi there, I need some help on getting divorced.

I got married in 2003 with a HK girl but after 3 months we then separated and never seen each other since. Thats almost 8 years apart without a glance at each other. I don't where she lives now and I hold the original Marriage certificate. I want to get it over and done with so could you give me advice on what I need to do? Will this be an expensive procedure? I have met someone else and we have been together for 4 years and plan to marry but I need to get the divorce settlements over and done with. I have read many ads and suggestions about procedures but my separation has been more than 8 years. What kind of proof should I provide to say that we have been separated for such a long time?


*Should I need to get a solicitor?

*Can my case be done without stress?


Please HELP asap.

What you’ll need to consider first is the fact that you separated only after 3 months of marriage, since quote-unquote “unless the court allows otherwise, you can start a petition for divorce only if you have been married for at least 1 year”.

Thanks alot for your help, Christelita. I had actually been to that site already but I will look at it again. I was just curious as to whether there are any other procedures to a marriage that been broken up for a more longer duration cos the problem is I have some land in Hong Kong and was unsure whether I would need to share it with my ex-souse. I was told by friend who is a barrister that if the land was given to me before the marriage then I can point that out as it does not connect with our marriage. Still unsure about it cos my friend works in the small criminal area. I know going to a solicitor to ask questions would cost an arm and a leg.

@stuff2go - you can divorce someone on the ground of 1 year separation (if both parties consent) or 2 years separation (if the other party does not consent). Since you have obviously been separated more than 2 years you can petition for a divorce under this ground. In the event that you do not know where to serve your soon-to-be ex the Petition, you can apply to the Court for the Petiition to be advertised in major newspapers. Hope this helps.
