My wife and I have been separated for over 2 years and she has gone back to her home country in Japan. Does anyone know if I can file a divorce in HK on my own without getting a lawyer? She has no objection to a divorce but she is reluctant to co-operate by coming back to HK to sign papers, and I'm not sure if she would sign anything sent to her. Anyone has similar experience?
Perhaps you could find someone who is visiting Japan - it's an elongated country - but might be "persuaded" to visit her and get a signature off her - for a fee.
Me, I'm going to southern Hokkaido next week - so I've set the "ball rolling" [& my spouse speaks some Jap too!]
Take a holiday to Japan, and bring her the papers. It's a wonderful country!
Thanks for your reply. My question is more about whether it's possible to complete a divorce while the spouse is not willing to co-operate or cannot be located. To be honest, I am trying to avoid the pain of speaking or negotiating with her again.
I know in my country it can be done, you need to fill in the paperwork, and if she doesn't oppose the divorce, I think it's for 5-6 years, then you are divorced. It takes time. Ask a lawyer, I don't know what the law in HK is.
