Q : Dependent visa to employment visa

Hello,

I currently got divorced with my husband.

We've been married for 12 years and I've been to HK for nearly 7 years(6 yr & 8mth exactly).

My visa will be expired coming August'11.

Will there be any problem if I change my visa base from dependent to employment for me to get perm visa?

I'm not so sure I should ask my ex to support my visa or ask my employer to support.

I tried to call immigration department but I failed cuz the waiting time was too long and I was too busy at work.

Please share if you know anything about it.

Fyi, we are not divorced yet in paper since we are recently seperated.

I post this thread in "career& working visa" but I didn't get any reply. If you guys know anything about it. please kindly share.

I feel really devastated but try to move on and get my life. Your kind advice will be very helpful.

If you have been in Hk for 7 years on a valid visa, dependent or working, then you are eligible to apply for PR status. What you want to avoid is not having a valid Visa for any period of time. Work Visas can take between 4-6 weeks to process, so if you are to change status (with employers support), I would do it sooner rather than later. The other option is to renew the dependent visa & soon as the 7 years is up - apply for PR

I shall ask my ex to sponsor then I will apply for PR.

So once 7 yeasr is up, I can apply for PR without support from spouse or employer, right?

I am very sorry to tell you this, but when you apply for renewal of your dependent visa you will have to sign a statutory declaration affirming that you are not divorced or separated. If you and your husband are in the process of getting a divorce or are living at separate addresses immigration will not allow him to sponsor the renewal of your dependent visa even though you only have a few months before you are eligible for permanent residence. You will be told that it is 'outside policy'. Unfortunately, you will need to apply for an employment visa, the sooner the better because you cannot overstay your visa by even one day. Also bear in mind that you are not eligible to apply for permanent residence until you have been here seven years (time spent here on a tourist visa does not count) and that it can take up to three months to process your paperwork for permanent residence so you will need an employment visa in the interregnum.

Surely if they apply to renew dependant visa, then whilst waiting for the outcome to be processed you are not overstaying, right?


You can only extend dependant visa if ur husband is prepared to fudge the truth abit re ur separation.

You could change from Dependant Visa to Work Visa easily. Get your employer to prepare a letter for you as sponsor and also prepare a letter stating why you are changing ur Visa status. Just tell them that you are divorced and want to continue working in HK...etc. Pretty easy and straight forward. I did that and got my Visa status changed and now am a PR.


Call the Immigration Dept. and they will guide you, they are really helpful.
