PERMANENT RESIDENCY

We are just about to start the process. My two daughters will be coming back from university for the summer holidays one has been in Uni for 3 years in the UK and the younger one for one year also in the UK are they entitled to HK permanent residency?

They both really want to come back and work here after their studies

Has anyone had the same problem. Is it easy to process yourself we got a quote from a company but they wanted 10 000HKD to do paperwork

Any advice would be appreciated

Firstly it depends on the age of the kids. Are they over 18? If so they will need to have visa's in their own right. If they have been on dependant visa's that are still valid the first thing is to get a visa extension. You cannot apply for PR UNTIL you have been resident for 7 years. This pretty much means extensions to all visa's so they are still valid throughout the process.


The process itself is relatively simple and can be done directly with immigration. There is no need to use a company unless you have a borderline case for PR.

If they have been normally resident in HK for 7 years, then they can apply for PR.


Attending Uni in the UK does not mean that they were not resident in HK. If their main reasidence was HK i.e. returned here during holiday's, your home was their primary address, you funded their studies, then this is a straight forward app. No need to pay anyone unless you want to not be bothered with all the admin required.

Both kids are over 18 one is 23 and one is 20 both are still on dependent visa's we will have been here 7 years at end of September my husbands company is going to renew his work visa together with myself and my kids for the next 2 years as they are still in full time education but we want to do the PR a soon as possible. My eldest kid took a year out from uni in the UK two years ago will that affect her

7 year status. I presume studying full time in another country also counts to the 7 year residency requirement. Should we let company carry on and get another 2 year work visa or should be we apply for visa extension at then get apply for PR end of September my only concern is that both kids would have left to go back to Uni by mid September and won't be here for visa extension.

Yes you will need the company to apply for another work visa and your dependant visas are in fact extensions of stay anyway. Once these are granted and you have been here for 7 years then you can apply for PR. However your daughters will need to apply when here in HK so you will have to wait for them to be back in HK to do the application.
