changing job but what about the visa?

Hey all,


before i wrote to the Hong Kong immigration office i thought i would seek advice out here because i would get more of a straight answer. So....let me give you my circumstances. I am just about to start a job and the work visa has been succesfully granted. However i am thinking of only staying at this company a short while and moving on to something else. I was wondering if i would need to apply for a new visa or can the visa i have be transfered to the new company? I would greatly appreciate any assistance with this!!

No, a visa is sponsored by your employer and with that visa you are only allowed to work for that employer. If you change employers then the new employer will have to make an application for a working visa for you which can usually be done a little quicker than the first, however do not take it as a given that the visa will be granted even if you had one with the previous employer.

I am in the same situation.. and evildeeds is right!!! I made the question directly to the officer..!! it probably may be quicker.. but still same application needs to fill out and requirements should be met.

It looks like as you all say, if i want to change jobs i will have to go through the whole process again, bloody immigration laws! many thanks to all!

What happens if you change jobs and your new application gets rejected for some reason? I know there are good chances of getting a new visa especially if you find work in the same line but however there is still that chance of rejection, can you go back to the first company (providing the company is ok-good relationship) and reapply from the start? And how long should one wait to change jobs if one has just been granted a visa?

As part of the requirement for a new work visa, you will need a letter from your previous HK employer to state that you had been relieved of the employment contract with it. Without that letter, you stand no chance of being granted a new work visa under the hiring company's sponsorship. Good luck. BTW, agree with GreenValleys - Be a law-abiding human being and show respect for your host country.

one thing of note is that you are permitted to remain in hk under all benefits until your original visa expires, with the exception of you cannot work. this as others suggest requires a new visa. my experience which is based on three different visas is the process is the same and is by no means expidited. So you can remain in HK, look for new work, keep your kis in school, zip in and out of HK with your fast track ID etc

I am just wondering, what actions does the employer need to take in order to sponsor me? Im on a 1 year working holiday visa at the moment but I am hoping to get sponsored so as I can stay after..

Hi Everyone,


I have tender my resignation from my current employer, and FEB was my last month with them. My employment VISA will expire in the month of SEP-14. I want to search for a new job here, So I am wondering how long I can stay here in HK and look for a job. If a employer cancel the visa sponsorship, in that case do I need to leave HK and go back.

You can stay/live in HK until September, the end of your visa. Once it is issued it isn't cancelled, it will be just that your company is no longer sponsoring you. You cannot work for anyone else under that visa though.

If you get offered another job by someone, they and you have to go through the whole re-apply for visa approval process as you did originally.

Hi Everyone,


I have resigned from my current job in FEB-14 and currently I am looking for a job here in HK. My employment VISA will expire in the month of SEP-14.

I wanted to visit my home back to India for couple of weeks, So I was wondering if once I leave HK can I enter back using my HKID, or I will need to come back on visitor visa.

Hi,I am in a slightly different boat. I came to Hong Kong with a permanent job, but quickly found it was not what I wanted. I am now in a different job under a 1 year contract. My contact expires in March next year, but my visa expires in December this year. I think my company will extend the visa, but I am wondering how long for, as I would like some time to look for a new job after the contract expires. Normal practice I think would be to extend 2 years if I had a permanent job.Can anyone help here?Porky

@Santsoh,Your VISA is valid until its expiry date, if you would be back before its expiry date then you could still use your HKID.BTTI was in the same situation before and what i did is just applied for a change of sponsorship at the immiv office in Wan Chai.It just took a day to process.You would need a few details from your new company is this will be indicated in the form and as well if i remember correct, your new company would provide supporting documents and as well a form to be filled up and sign by them.Better to check with the immig office for the requirements, for sure your new employer would be able to provide them.
