I am planning on handing in my notice to take up a job aboard, outside of HK. My employer has a 3 month notice period, which I only intend to give one months notice. The 2 months I must pay out. However I dont consider my job requires a 3 month termination period and was wondering what happens if I refuse to pay it?

KFCBOY, your employment contract either has a 3-month notice or it doesn't. You say your empoyer has a 3-month notice period, so presumably that's what's in the written contract. Legally you're obliged to pay him two months' salary if you leave after one month.

Most dont want you to stay after resigning.
Talk to them and see; perhaps you can work out a compromise.
If you dont want to stay; its not good for them anyway to just sit out time.
Not paying; are you leaving HK for good ?.
All taxes paid, you plan to withdraw the MPF etc ?.

Planning of leaving HK, leave the job and dont pay the remaing month in lieu. Havent pay taxes for long time, cause it didnt reach the bracket after having a kid. Planning to come back again in 6mos or a year to settle my MPF. Thinking whats the worst thing they can do for me for not paying them. Whats gonna happen once I come back.

If you have a contract, you can go to labour department and get free advise (in Wan Chai for example; just drop in). There you can ask what happens if, and so on. Ask about MPF, and if your empl. can claw that back from money you potentially own them, unpaid taxes (even though you should not have any) etc etc.

I think its Revenue Tower, 34/F; just go and ask with you're contract, or questions and you will get some help and so you can make decision on how to act.
