Redundancy - resignation

Hello,

My company (in HK) is going through some major downsizing activity and jobs are getting cuts.

The Company is currently proposing senior people to take on a less senior position. The offer put on the table is quite simple they either accept the offer or the company consider that they resign from their job and therefore do not get any redundancy.

The Company is doing so to reduce the total of overall redundancy payment to made. I would like to know if a HK company as the right to do that. Any advise or information?

Here is a useful guide to the Employment Ordinance, written by the Labour Department in plain English:

In particular, see Chapter 10: 'Employment Protection'.

I was retrenched by a Hong Kong company in 2011, before I had completed 24 months of employment there. 24 months is the minimum amount of time needed for entitlement to severance pay.
