Working on Dependent Visa After Spouse Quits?

ORIGINAL POST

I am here in HK with a dependent visa (my wife had her work visa sponsored by her employer). However, my wife was forced to quit her job recently. We have 8 months left on our visas, and I was recently offered a job here in HK (as I was looking for jobs myself). My question is, can I still legally work using my dependent visa, even though my wife has quit her job and her sponsorship is in the process of being terminated? My hope is that this company will end up sponsoring a working visa for me in due course, but for the time being I think they are looking for me to start right away with my existing visa. Any advice is appreciated. Thanks.

From the previous threads dealing with a similar (not exactly the same) situation as yours, I can remember that once the visa (both the work visa of your wife, and your dependent visa) is stamped in your passport, there is no mechanism to "cancel" the effectivity for it. I gather that both you and wife can continue to use it (go in and out of HK, work, etc.). The limitation is with your wife as she can only work for the sponsoring company while there's none for you. To make absolutely sure, you better ask immigration directly by calling or visiting them in person. They're quite friendly and helpful...

Hope things work out well for you.

Hi Flagler1, you can still legally work in HK. You can start right away with the new company. After you start, ask your new employer if they would mind sponsoring you. If they agree, then just apply to the Immigration department to change your status from dependant visa to employment visa. Once that's approved, you can then get your wife to be your dependant. I'm assuming your job is in the professional field.

be careful, as I have a friend who swapped jobs and didn't tell immigration about it until his visa came up for renewal. Imm was not happy. I think your wife needs to inform imm that she no longer works for the company.
