I have a small business in HK, one staff member who has a supervisory role I employed early last year and she was continually taking a day or two off for sick leave with Doctors notes that were hopelessly unspecific.
I let it go and now she is pregnant and doing the same thing. Worse is that the sickness descriptions again seem completely unrelated to the pregnancy.
I have another staff member who is pregnant and she has a good work record before the pregnancy so I have no issues with her having time off, ditto when the baby comes.
I know the law prevents me from removing her while pregnant but we cannot afford to keep her to be honest as she's not contributing and holds up reviewing work from more junior staff.
Any advice on how to get around this would be welcome. She signed a contract allowing us to send her to a Doctor of our choosing if the sick leave was continual and periodic. What do you think is the best result?

How many sick days has she taken? Under the Employment Ordinance, after she takes 36 sick days off, you can request that she goes to a doctor of your choosing and she has to comply.
