Self employed and no work visa needed?

Is it legal to be self employed (i.e. be a consultant and teacher for a number of tutorial schools and private lessons in Hong Kong) with own company started and registered here and not need a work visa?


I could make a lot more that way as private lessons pay alot but am afraid in case I'd leave myself open to having done something wrong, illegal etc.

I guess I'm a bit confused as I was told by a business adviser here that if I stay for 6 months on a valid passport that anyone with a consultancy firm can do this here as long as I'm not an employee(ie. I would be the director of the company and) and not gaining a salary (i.e. only receiving an income as opposed to employee salary from the business).

I believe you can set up a company and obtain a work visa... but I believe there is more to it than just registering a company... I think you need to present a business plan and have a certain amount of start up capital invested...

You can register your company and your company will them apply for a work visa for you with imm dept. Whether they aproove would depend on how sound your paperwork is.

I wonder then if that means (1) I can have a private limited company here while (2) working for another school as an employee also, thereby having HKID/visa as well.

Cara is absolutely right. Just because you go through the process of setting up a company does not mean that you will get your investment visa approved. Every case is treated on its own merits, so just because you may kniow people who got their own company and then got a visa does not mean you also will get one. The criteria you have to meet is that your company will benefit the HKG economy, as Cara said, by employing locals. You also have to show that there is a need in HKG for a business like yours.
