New company hiring from overseas

Hi,


I'm planning to start a small tech company and would like to hire a programmer (friend) from UK. There will be rather little initial capital, so it's probably between HKD$10k-$50k. Given the small size, will I likely be able to sponsor the application of a programmer from abroad?

You would likely have to demonstrate you cannot find a local to fill the job - there are plenty of qualified programmers in HK so this might be difficult...

You could show you tried looking by posting adverts in online sites and even dailies. Then show to the immigration department that you didn't get any that met your requirements.


Having said that, this might not be possible for a newly formed company. The Immig Department knows this is an immigration loophole and they most probably have closed it a long time ago.

So, how do I show that I can't find local candidates who are satisfactory?

Why would newly formed companies hiring overseas workers be a 'loophole' at all? They'll still be properly employed.


I have another question: if the salary is adjusted after the visa is approved, then do I need to inform the Immg Dept?

Obviously you're thinking only from your perspective (a legal business using a legal company).


If this is granted, anybody can open a business and bring in anybody in the guise of being hired as an expat employee.


As mentioned above, you run adverts and collect applicants' info. Then you can use that as proof that you searched, but the applicants didn't meet your requirements. As for your last question, you don't have to inform the Immigration Department but if they catch you, you'll be in trouble as that is deception. There were some items in the news before regarding some company doing this and they were prosecuted (don't know the end story though).

Right. Would a business that has been registered for 6 months be too new for employing expat employees?


If I require candidates to be native English speakers, then I'd have to bring people in from abroad. Would the Immg Dept find it fishy?
