Legal Advise needed: problems w. expat health insurance

I need some advice from a lawyer who is versed in dealing with health insurances (overseas expat type/based in Luxembourg).

I have sent in my first claim of dr visit, referral & 10x phyiso (so not a hughe bill by all means) Now they are asking for 3 years of health information  for inpatient and 5 years for outpatient treatment to be released by my prior health insurance. What the...???

This seems totally arbitrary and insane to me. They did not request this information when I applied for coverage either!

I feel they are just doing what they want. With you and I need to learn my rights here ASAP.

Please help!!

Thank you for your reply.

It is an individual coverage, not from an employer or group.

I thought I had read the contract carefully and have re-read it again. I can find nowhere that they require 3 or 5 years health history to determine whether a claim is per-existing condition.

I was told when I called yesterday, that with INDIVIDUAL plans (so not a group/employer) they always!! ask for the health history dating back that far if it is any musculoskeletal related claim, e.g. Back problems.

Again, I have not seen that in the contract anywhere! How come they tell me such things now? It's kind of an important detail right. I feel they have with held important procedural information at signing the contract!

Also they have been sitting on these claims almost 7 weeks before telling that's what they need. Who knows how long that process is going to take now and meanwhile I keep

Paying my premiums on time of course.

I am not venting, just trying to paint a clear picture for who ever else might have some advise on my situation.
