Hi,
I am writing to get legal advise from you regarding my divorce situation.
I am a permanent Hk resident, holding a chinese nationality. I have been married for almost 7 years with a woman from another country and have a 6 year old kid. My wife is not a hk permanent resident but will get a permanent hong kong citizenship in October when she completes her 7 years in Hong Kong.
My main thing to ask you is that, if I don't sponsor her this time for extending her visa so that she will become a permanent hong kong resident, can she get the permanent visa and become a permanent hong kong resident by herself even if I don't sign any declaration forms as her husband/sponsor?
I want legal advise in this matter as soon as possible. We are thinking to separate. I will divorce her but I want to know, will I have to give her a certain amount of percentage from my property and savings? Will I still have to take her and my son's responsibilty in supporting them financially? What if I want to keep my child with me, what will i have to do? Can the child stay with his father or he has to go with his mother?
Please let me know as soon as possible of what to do. I cannot afford a legal lawyer in this matter so please tell me what to do.

Why would you want to prevent your wife, and mother of your child, from becoming PR?
There was a situation on here a short while ago, a man in same position as you wife, just a couple of months to PR. He spoke to immigration, they extended his visa and he ultimately got PR. If you wife does the same thing, and of course being a mother to a child here it's pretty much going to be the same. So your spite will not work.
As for the marriage, yes there will possibly be a division of some assets, especially with a child involved. HK courts seems to favour joint custody wherever possible. If you wife has sole custody you will need to pay some financial support. Now you have property and assets and yet cannot afford legal advice?
