I recommend Alex Ng (a.group) 92892444. He works hand in hand with his contractor name John. Both are a very good team. Alex is professional, speaks good english and dosen't give you any bullcrap. They tell it like it is and try to give you the best advise. He fixed a few things around my home and we were quite pleased with their work.

are we allowed to recommend contractors other than those advertised with this website? I get so confused sometimes with (dare I say it) ...the editors double standards as I've had regular posts deleted because I've recommend people or companies not advertised on this website. I thought this was a questions and advice forum?

One of the main purposes of the forums is to allow people to ask for and receive recommendations.

But as our rules state we are not an ombudsman and we are not able to determine if a negative comment is correct or malicious so we do not allow such content on the sites.

As indicated on another thread perhaps someone would want to set up a site for that purpose - but make sure to be prepared to make no money - and get a law firm retained....

The rules of this site have been thoroughly thought through and we will not allow negative comments about companies or individuals under any circumstances.

That is the fast road to bankruptcy - see www.icered.com which was hugely popular but made no cash and was sued into insolvency doing exactly what you are suggesting.

Again, its not difficult to set up a message board web site that allows people to post complaints against companies - but be prepared to shut down the minute the first judgment arrives for publishing libelous comments...

Sorry but we are running a business and we must take such considerations into account. The policy as it stands will not be changed.

Thanks for your replys.Contractor i used did very poor work & now it is falling apart so have to start again, and donot want to use one that is not good again. The consumer council can do little and i am unfamiliar with court process to have to bite to bullett so to say. Thank you again. Recommends are best.

This is not very fair, you hired a contractor who from what you say didnt perform as per the terms of your agreement and you are spreading negative comments about the company.

There are for sure two sides to every story and thats what small claims court is for so why not sue them before you report them to everyone?

Maybe you dont know it but you can be sued yourself for libel or slander for writing/saying bad stuff about people if it turns out not to be true.

You might want to be careful about that (of course if you have a small claims win on your side then you can then make that public without any problems I would think).

A person has every right to express a negative opinion on a company in private, actually in public too, but since the posting rules on this forum are quite clear then that has to be avoided. nw has not expressly named the company and if someone asks for a personal message as to whom nw thinks they should avoid using, I think even ed would stop short of censoring personal messages.

We do not censor PM's.

I am not a lawyer (actually I am not even a real Editor) but I think you might have a problem re: expressing a negative opinion about a person or company in public or private - IF that negative comment is found to be untrue.

statements need to be published for their to be libel, I think that would be hard to extend to personal messages or individual emails. you could argue it, because technically you are publishing it on the internet and those messages could be mas distributed, but I rather think libel would probably be incurred on the person distributing the message, rather than the writer. Especially if the message is in good faith.

"English law allows actions for libel to be brought in the High Court for any published statements which are alleged to defame a named or identifiable individual or individuals in a manner which causes them loss in their trade or profession, or causes a reasonable person to think worse of him, her or them"

Personally I think you would have a hard time convincing any judge to grant damages if you made a statement public or private which used the phrase "my experience with XXX company was terrible". If you go on to relate the specific experience, then it of course must be true.

DB, once again I agree with you!! Laws in Hong Kong do not favour consumer either. If you have a bad experience with a shop or a service, you want to voice out. I am a local (I speak the language) but yet I had bad experiences with most of the renovators I used. You can stop going to a restaurant if you dont like their taste (one off bad experience), but you live with your renovation workmanship at least for a year or two. So it is very important that we have good recommendations or bad ones to avoid. I was discussing a re-paint job with one of the local shops in Tai Po. Good price and I almost paid my deposit. But didnt because when I was choosing the colours for the paint I found out his price only included 2 colours for the whole house - one colour for the whole ceiling and one colour for all the walls. That wasnt said in his quote. He didnt mention how many colours I cld have and I 'forgot' to ask.

innoncence I am not sure I get your point.

The Consumer Council can do little in the case of a consumer getting a raw deal and yes there is the Small Claims Court, however, the process of the small claims court is some what complicated and time consuming for non Cantonese speakers. As the poster above says, some of these contractors are a dab hand at the Small Claims. So why not get recommendations before hand and as well as getting other peoples opinions of their bad experiences to avoid legal action in the first place.

I have not seen a case in law of a libel action re people sending private messages to each other and tend to agree with Digital Blonde if you use the phrase "my experience with XXX company was terrible" it would be very difficult to bring a case in law.

Lets face it if you were a good reliable contractor that carried out quality work you would not have a problem with it would you. It's those contractors who operate badly and rip off the consumer that would be concerned.

I have many friends that have been the victims of bad contractors in Hong Kong and that is not very fair either and sadly the laws in Hong Kong do little to protect them.

Before I use a contractor for any major work I will ask for references and I will check them out and I will ask as many people, organisations etc. if they have an opinion on the contractor before I employ them as I will ask the people on this site who the contractor was that they had a bad experience with then I will make up my own mind.

A couple of weeks ago, someone asked for storage people and I posted 2 companies who are not advertisers on this site and it was immediately deleted and the Editor put a link to storage company advertised this site. Now this was not a negatove comment so why was it deleted?

Thanks in advance for your advice.

We have had a problem with some storage companies popping up and self-promoting on every thread that mentions this topic... which is not allowed. Also we have plenty of storage companies on the site already http://hongkong.asiaxpat.com/directory/expat-services-directory/storage-facility/

i don't think posting two different competitive companies with links (competitive against each other) is self-promoting. half the time I don't think the people who delete the post actually read what it says or where the link leads to.

If your not interested, then ignore the discussion. No one is forcing you to read anything, there is plenty on here that I am not interested in nor find relevant but I don't moan about it, and to be honest there is relevance the libel point pertains to the fact that criticism is not entertained regarding services that you yourself wished at a point in time to procure. There is nothing random about it.

NW, Sarah James. I need your help. My contractor ran away finishing only 1/2 of the work that's been paid for. He claims that the upfront 30% deposit and the subsequent payments that I made was paid to the design company and that he didn't receive enough to pay his own workers. I have told the owner of the Design/contracting company that he needs to finish the job. He claims he has no money and cannot continue. At this stage, I don't whether to hire a lawyer to pursue this guy or move forward with a new contactor. My concern is even if I ligitate, this guy doesn't have any money to pay.

Reading your comments about Small Claims Court & the Consumer Council makes me worried about how I will even get through this.

Appreciate your thoughts. Thanks.

Without being able to state his name, if one of the people mentioned in this thread also runs a storage service, then please stay away from him. We used his storage services and he ruined some of our goods and stole some boxes and we ended up filing a police report and reporting him and his company to the Consumer Council (neither of which helped get our goods back). I found him from a recommendation from this message board and even called his expat clients who recommended him before I hired his company (although maybe they were fakes too).

Please PM me denisiel, I'd like to warned of any potential and unnecessary grief if I can avoid it by using a rogue company as I am searching a contractor to do some work.

Many thanks.

Dadda - could you message me with the contact details of your contractor. I now need a new contractor to REPAIR the botched job that my contractor left me with. I decided not to go to the small claims as I could not actually bear to deal with him any longer and I am now accepting the fact that I have been the loser in this. If anyone would like to hear my story before making a decision on a contractor please drop me a line, I offer this advice for you to make your own decision - I don't want this post to be deleted because I would rather warn people to be careful and not just to assume that just because contractors advertise their supposedly professional services that they deliver. I now know a couple of other people simply through word of mouth that have had equally bad experiences with this same contractor so please don't be the next victim.

My advice would be to ensure that you speak to someone that has actually had work done by the company you have named above. Ensure that they give you a personal reference as have to agree with cheesygrin. Before you use any contractor it is best speak with previous customers to find out what they think then make your mind up then. It is an industry that is more or less unregulated and many of these companies do not hire full time workers but get who and what they can on the day.. there sure are some cowboys out there.
