Quit job - when do I have to leave HK?

I have just quit my job in HK, I have a one month notice period which I have to serve out. I currently hold a work permit that expires next year. How long before I have to leave HK? Can I travel outside HK and return over the intervening period on my ID card? When I finally leave HK, do I exit using my ID card? Thanks

You can stay in HK for as long as your current work visa allows. However, once you leave HK you will be able to re-enter only on a tourist visa. And I've heard conflicting stories about the ID card, but our personal experience (we left permanently last Saturday) is that we still have ours - for what little it's worth, because it won't be worth a sou if I present it on my next entry.

There is a real good chance that your smart ID will still work for entry and exit upto the time of your visa expiry. You can give it a try, if doesn't work, then go through the visitor line.

That's right. Your employer is supposed to inform Immigration who will then note the fact that the EV (employer-specific) is no longer current. So when you try to enter HK the next time the fact that it is no longer current will be picked up - and hence the tourist visa.

Immigration web info is not clear on what happens to a person's status to stay in HK if the underlyihg job is terminated. Perhaps it is as TC says, the visa is canceled once you leave, but I knew a woman who after losing her job was able to leave and re-enter HK many times on her employment visa prior to expiry. She found a job after almost a year, and was aple to get new work visa without a problem.

I am fairly certain for two facts under such conditions: 1) one can stay legally in HK to the time the employment visa expires. 2) one cannot work for another employer without first getting approval from immigration.

Condition of reentry is unclear. Maybe someone can ask the customs officers next time he goes through the airport and report back.

TC is correct re the Visa. Yr ID card is immaterial if you re not a permenant resident. You can still use it to come in through the resident channel but you will be stamped as a visitor and given the length of stay that is relevant to the country of yr passport.

When you quit your job your employer is required to inform the Immgration dept that you have ceased to be its employee and request a cancellation of the visa. However, in pracitce the dept does not cancel the vsia and turns a blind eye to your stay within the period of the visa. During this period you may travel in and our of HK. When you finally leave you may use the ID card. If you intend to work in HK find mew employment and apply for a new visa.

Is there any way to start up your own business in order to get PR? I have just over a year left and would like to make HK my home,.. But can't stand my current job.. The ROA says only that the person must demonstrate intent that HK is their permanent home.. By having lived here and held valid resident visa for seven years... Very vague! Wondering coz I do own my own home and can set up a business if that helps (eg investment visa)..

Shayne. I am currently in the same situation as Kayakking. I left my job and have about 17 months to my 7 years. But my employment visa stretches through to 2014. Any idea whether setting up a BVI company works? The company will have genuine operations.
