Redundancy salary amount

My current monthly salary is based on two parts – the base salary and the housing allowance. Question: which amount of the salary is to be used for calculation of the redundancy package (base salary or both of base & housing allowance? Thanks

Depends.

Some salary are divided into Salary and Housing to offer tax incentives. So it ought to be S + H.

In the employee's point of view, S + H is good. However in the employer's point of view it is S only.


Think about it, for a salaried employee, where is the bonus based on? Is it S + H, or S only? It's always based on the Salary only (as far as I know).

Most employers talk about salary as total comp. The fact that part of it is paid in the form of rental reimbursment is purely to reduce the tax liability of the employee.


If you see a job advertised for (say) 100k a month do you view that as S or S + H ?

It could be interpreted as: S= net salary and S+H = Gross salary.


Does anyone know any regulation/ rule in HK about the definition of “salary” for calculating the package?
