Bed Rest Leave paid/ unpaid??

1. If a pregnant woman is feeling unwell and the doctor advise her to take a bed rest, say for 2 weeks, is that woman paid or unpaid during these 2 weeks?


2. Is that 2-week leave counted as sick leave by law?

cri, i have read through the labour ordinance:

sickness day = a day on which an employee is absent from his work by reason of his being unfit therefor on acoc*nt of injury or sickness.


HOwever, pregnancy is neither 'injury' or 'sickness'.


My friend was not paid, for her bed-rest leaves, by her company. Those leaves were counted as unpaid.

most companies, with a note from the doctor, will treat as paid, and past a certain amount of days at 4/5 pay. Sorry to hear your friend is a more difficult company.

Agree with waffle_hk. The employment ordinance is supposed to protect discrimination against pregnant women and if a woman is sick when pregnant (or as a result of being preganant) this shouldn't exclude her from sick leave.

If you are sick during pregnancy with Drs note, it should be paid Sick leave.

You also get 10 weeks paid maternity leave, with a possible addition of 4 weeks if you are sick, and need to be in the hospital right before or after brith with a Drs note.
