"Surrogate Motherhood


This will be the landmark case which will set precedence for other cases in the future.


A former Hong Kong lawmaker and active political figure and her boyfriend became “parents” of a baby girl born to a surrogate mother in the United States in June 2005. The unmarried couple hopes to legally adopt the baby, who was born from the egg of a surrogate mother of Chinese ethnicity fertilized by sperm from the male partner of the couple. The couple has sidestepped Hong Kong law which would have prohibited them from commercial surrogacy. The couple turned to commercial surrogacy after failed attempts for adoptions, partly because of their unmarried status.


The SAR will witness the legal proceedings initiated by the couple to adopt the baby girl when she comes to Hong Kong in August."


Commercial surrogacy is banned and IVF is permitted only for infertile married heterosexual couples. The Council on Human Reproductive Technology and the Human Reproductive Technology Ordinance are the authority and law, respectively governing surrogacy in Hong Kong .
