deposit - easy to get it back?

Guys,


i am about to rent an apartment. I am curious about how easy it is to get back the two month deposit at the end of the leasing contract. i of course mean generally speaking, compared to getting it back in other places / countries... i got that it is particularly difficult here, so i am getting slightly afraid, even more as my agent told me that i will probably never meet my landlord in person...

Actually if you look at the agreement you are cheating by using the deposit, But it is a pretty common practice, and the landlord would have to initiate the suit against you and one assumes prove damages against reclaiming the deposit.

Don't blame you...I have always taken the deposit off the final rent. Though every one of my agreements ( lawyer and form) have stated clearly that this can not be done.

I imagine that using the deposit for the last two months' rent is a good plan (though technically illegal as already mentioned) unless you are getting housing reimbursement and need receipts for your taxes.

I think in most any case the landlord can do nothing to you. The deposit is for damages so if they have abnormal damage (not normal wear & tear) they could try to claim it back in court...otherwise they have been paid (in effect) for the full term. Getting any action would probably take longer than the two months.
