Fired during probation for informing about pregnancy

hi there,

my hkg girlfriend who was working for a respected english insurance company for the past two years recently got a job offer from another, small sized insurance company with higher salary and better working arrangements. She started work three weeks ago, however, she had no training, nor any workload during that time. Just sit there and wait for time to pass. She started feeling unwell last week, went to see her doctor and got the fantastic news of pregnancy. How wonderful, happy to be parents! She wanted to comply with the HK law and inform her new company of the news. She did and two and half hours later, she was fired with immediate effect. What suggestion do you have and is there anything we can do to get compensation? Thank you very much for your kind replies.

Stephen

thanks for your reply. we're contacting the Equal Opportunities Commission and yes it seems that this is considered discriminatory. she's devastated obviously and is really pissed about that company globalhealth. i mean they provide healthcare insurance to expats are not even able to take care of their own employees...unbelievable. we will definitely threaten legal action.

I would be contacting the Labour Dept first of all.

I would be contacting the Labour Dept first of all. As for informing the employer of the pregnancy almsot as soon as she became aware herself I don't think that was a good move anyway.

hi and thanks for your comments kenwin

yes we did but so far no reply. the fastest and may I say very efficient and kind person we talked to was at the EOC. However, at the same time we will go to see the LD and threaten that cpy to go to legal action.

my gf as i mentioned is a local hkg. i do understand her as she wants to be within the law which requires a known pregnant person to inform her employer. so she did. she played nice, did not wait for the end of her probation - which she could have. at least, she now knows what could have been later on and probably have not a good pregnancy working in that cpy...

we do not know what to expect, perhaps some financial compensation as it has taken a toll on her health since last thursday (depressed, not eating, crying all the time...) and i am really afraid of the consequences on our unborn child.

She has to eat! Crying and depression is not uncommon in pregnancy anyway, but please make sure she eats!
